TERMS & CONDITIONS

Please read these Terms and Conditions carefully before purchasing any membership, package, session, or event and using any of the services offered by Team Yousfi Combat & Fitness.
These Terms and Conditions set out and constitute an agreement between you and us for the supply of services. Please ensure that you read and understand these Terms and Conditions as you will be bound by them.

1.    Information About Team Yousfi Combat & Fitness
Team Yousfi Combat & Fitness (or “Team Yousfi”) is the trading name of Yousfi Fitness, registered in Dubai under professional license number 978507 and whose registered office is Marina Wharf 1, Shop No. 11, Dubai Marina, Dubai, United Arab Emirates.
You can contact Team Yousfi on +971527209910, or via email teamyousfi@gmail.com. Unless otherwise provided for in these terms and conditions, if Team Yousfi need to contact you it will do so by Glofox App, phone or email.

2.    Purchase of Memberships, Class/PT Packages, Store Items
Available Memberships, Class/PT Packages and Store Items are listed on the Team Yousfi Glofox App and Web Portal. Team Yousfi will periodically inform and update via social media, App and other suitable means of the availability of new memberships, special promotions, events, clinics, camps, items, etc., specifying the venue, date, start time, duration and description.
Memberships (pre-paid and recurring monthly billing) and Class/PT Packages (pre-paid) shall be purchased on the Team Yousfi Glofox App or Web Portal through online payment by credit card. The card details will be saved on the member’s profile for use in future purchases.
Payments for memberships with recurring monthly billing will be automatically charged on the stored credit card on the same day each month. This type of membership will be automatically renewed at the end of each period unless cancelled within 7 days before the renewal date. Please refer to “How to Cancel a Membership with Recurring Monthly Billing” if you wish to cancel.
In case you require any support with online payments please contact Team Yousfi staff.

3.    How to Cancel a Membership with Recurring Monthly Billing
Cancellation of auto renewal memberships with recurring monthly billing shall be made by contacting our staff within 7 days before your next payment is due. You can access your account at any time to see when your next payment is due. If you fail to cancel your membership within 7 days before your next payment is due and your membership is auto renewed, a refund will not be provided. It is your responsibility to cancel your membership within the time frames set out above.

4.    Discretional Membership Freeze/Suspension
Under exceptional circumstances (travelling abroad, sickness/injury, etc.) and subject to Team Yousfi management sole discretion, members can request to suspend a Membership for a maximum of 1 consecutive month every 12 months.

5.    Validity
All classes, sessions and packages have specific validity from the date of purchase, for which they shall expire with no refund, if not utilized by the client before the expiry date.

6.    Refund Policy
Team Yousfi has a no refund policy. Any payments already made towards any membership, auto-renew subscription, service, or product (unless the product is proven defective) is non-refundable. In exceptional circumstances, Team Yousfi Management may consider a membership transfer to another person under payment of a transfer fee of 100 AED.

7.    Termination Due to Missing Payments
For recurring billing memberships, the system will attempt to get a successful charge from your stored card 4 times on every billing cycle. This includes the original charge attempt on your regular billing date and 3 subsequent automated retries. Kindly ensure sufficient funds are available and card details are up to date to avoid suspensions of the service.
Team Yousfi reserves the right to suspend all services if you fail to pay any type of membership.

8.    Cancelling if Changes to Terms and Conditions Adversely Affect You
We reserve the right to change or add to these membership Terms and Conditions. If by making such changes you are adversely affected, you may terminate this agreement. For the avoidance of doubt, however, changes to schedule, facilities and hours of operation does not constitute a change of this membership agreement for the purposes of this clause.
You can also cancel your membership if we breach our obligations and we do not fix the breach in a reasonable time after you have told us about it in writing. We will refund you any membership fees you pay between the date of notification and the date on which we decide that we cannot fix the breach.
In either case, you need to give 30 days’ notice.

9.    Collection and Delivery of Store Items
After successful online purchase all Store Items can be collected at Team Yousfi facilities. Delivery service is available at additional cost, please contact our staff.

10.    Booking
Each member can book multiple classes/sessions.
Group Classes and PT Sessions can be booked via App or Web Portal as follows:
•    Group Classes    From up to 2 weeks in advance until starting time
•    PT Sessions    From up to 8 weeks in advance until 24 hours before starting time
Each Group Class has a set maximum capacity. If capacity is already full you can register for a space in the waitlist. In case a free spot becomes available due to someone cancelling, all those in the waitlist will be notified through a push notification on the Glofox App and the first member accepting will secure the booking.

11.    Booking Cancellation, Late Cancellation Policy, No Show
At Team Yousfi, we want everyone to have the opportunity to experience our Group Classes and PT Sessions. If you cannot attend a class, please be mindful of your teammates in the waiting list and cancel your booking as soon as possible, so you can free a space for them.
Members can cancel their bookings via App or Web Portal as follows:
•    Group Classes    Up to 1 hour prior to the class starting time
•    PT Sessions    Up to 24 hours prior to the PT Session starting time
If you fail to cancel a Group Class within the required timeframe, it will show as Late Cancellation and might affect your future ability to book further classes. No-Shows will be charged 50 AED.
PT Sessions Late Cancellations and No-Shows will be charged.

12.    Changes to the Schedule
Team Yousfi may need to make changes to the Group Class schedule or PT Sessions availability. Clients will be notified of these changes as soon as practicable by social media, booking App, email, phone, or other methods as deemed necessary by Team Yousfi.
From time to time for various reasons beyond its control, such as but not limited to a unavailability of a trainer or venue, Team Yousfi may need to cancel a Group Class or a PT Session that a client is due to attend. Not less than 24 hours before the class/session start time Team Yousfi will notify the client of the cancellation and confirm that the cost of that class/session will be held to his or her credit for application to another class/session to be selected by the client.

13.    Minimum Age for Adult Group Classes, Kids Group Classes
Members under the age of 14 are not permitted to participate in regular adult Group Classes. Members may be required to present proof of age at any time as deemed necessary by Team Yousfi.
Kids/Teens Group Classes are listed separate in our schedule. A parent or guardian will be required to review and sign these Terms and Conditions and membership agreement.

14.    Promising you are in good health
On the day you purchase a membership/credit and each time you use our facility, you promise us that:
•    you are in good physical condition
•    you have no medical or other reason why you cannot or should not do active or passive exercise

15.    Seeking Expert Medical Advice
Our staff are not medically trained. They are not qualified to assess if you are in good physical condition or state if you can exercise without risking your health, safety or comfort. It is your sole responsibility to seek expert medical and other advice before starting any exercise program with Team Yousfi. This remains your own responsibility at all times.

16.    Participation in Group Classes, PT Sessions or Special Events
Without prejudice to the foregoing provisions in these Terms and Conditions, at all times during participation in a class members must do all such acts and things, and comply with all such directions and instructions, which the trainer taking the class considers necessary to protect the health and safety of the member, other members participating in the class, Team Yousfi staff, and any other person for the time being present. If the member fails to do any such thing, or comply with any such direction or instruction, the trainer may require the member to stop all further participation or limit or restrict any further participation as the trainer considers necessary to ensure such protection. If further participation is stopped or limited or restricted, the member will not be entitled to any refund of any of the cost of the class or any other compensation.
In consideration of using Team Yousfi Combat & Fitness (registered in Dubai as “Yousfi Fitness”) facilities (the ‘Facilities’), I hereby acknowledge by accepting these terms and conditions, that exercising at and using the Facilities may involve a significant risk of physical harm or personal injury, including permanent disability and/or death.
I am aware that the Facilities’ insurance provider will not cover any potential injury, loss or damage I may incur through or on occasion of using the Facilities, and I confirm that I will hold harmless the Facility for any such injury, loss, or damage. These injuries may include but are not limited to muscle pulls, strains or tears, broken bones, heart attacks or any other illness or soreness that I may incur.

I understand that classes at Team Yousfi Combat & Fitness may be physically strenuous, and I hereby affirm, and I affirm each time I participate in a Workout, that:
•    I am in good physical condition and do not suffer from any known disability or condition which would prevent or limit my participation in the Workout; and
•    I am participating in the Workouts voluntarily and at my own risk.
   
I confirm  that Team Yousfi Combat & Fitness (registered in Dubai as “Yousfi Fitness”) including its officers, employees and agents shall not be liable to any person whether in contract, tort, under statute or otherwise for any injury, loss, damage, death or economic loss whatsoever, whether consequential, direct or indirect, caused by or connected with my participation in Team Yousfi Combat & Fitness classes, as a result of my voluntary participation and enrollment.
I agree that Team Yousfi Combat & Fitness will not accept responsibility for loss or damage to any personal belongings left unattended on the premises.
17.    Respecting Our Equipment and Other Members
You are responsible for using our facilities and equipment correctly. If you are not sure how to operate any equipment, please ask our staff before you use it. Note that you will be responsible for any damage that you might cause through a willful act or negligence. If you intentionally damage any equipment or any part of the facility, you will be liable for the full replacement value of such equipment.
As a courtesy to other members, please ensure the following:
•    Use a clean towel when you use equipment, including exercise mats
•    Keep to the set time limits
•    Keep phone calls to an absolute minimum
•    Put equipment away after use
•    Always obey staff directions

18.    Wearing suitable clothes
All members and guests must wear suitable attire and remove their shoes in the exercise areas. We do not allow clothing with offensive images or inappropriate advertising. Any staff member, at their discretion, and in line with this Policy, may refuse you entry to our facilities or ask you to leave if your clothing is deemed inappropriate, offensive or unsuitable, at the discretion of Team Yousfi management.

19.    Personal Hygiene, Health & Safety Regulations
Personal hygiene is of upmost importance within the gym environment as this also has an effect on other gym users. Please carry a towel to wipe down the equipment after use and ensure your own hygiene is of an appropriate standard.
Team Yousfi staff is committed to ensure that all applicable and updated local Health & Safety Regulations are strictly adhered to.

20.    Drug & Banned Substance Abuse Policy
There is zero tolerance to drugs or banned substances. If any member is found to be encouraging, supplying, facilitating or taking illegal drugs or banned substances, their membership will be immediately cancelled without recourse and no refund will be given.

21.    Non-Discrimination and Non-Harassment Policy
At Team Yousfi we are all part of the same Team, we embrace and celebrate our diversities. We will therefore not tolerate any act of discrimination or harassment based on race, colour, gender, religion, political opinion, national or social origin.

22.    Laws & customs of the United Arab Emirates
Team Yousfi staff and members alike are to pay due respect to the civil and religious institutions and customs of the United Arab Emirates. This includes dress code and code of conduct during their time at Team Yousfi facilities.

23.    Facing Instant Cancellation
Your membership may be cancelled without warning if you behave in an inappropriate manner, for example if you:
•    Threaten, harass or intimidate others
•    Continually disobeying staff directives
•    Damage equipment
•    Use, supply or encourage illegal performance-enhancing drugs
•    Instruct other members when we have not authorised you to do so
•    Actively try to damage the Team Yousfi brand or reputation
•    Any reason as deemed appropriate by Management at their discretion

24.    Utilization of Personal Information or Media (of all Forms), Marketing Preferences
Team Yousfi will use the personal information you provide in connection with your registration, your purchase of classes, sessions or events and packages of classes, sessions or events, your attendance at classes, sessions or events, and to inform you about our workouts and associated products. You can update your marketing preferences through the Team Yousfi Glofox App or Web Portal by accessing your profile and tick or un-tick the box for “Receive marketing emails and push notifications”.
Team Yousfi will only give your personal information to third parties where the law either requires or allows us to do so.
Team Yousfi may use any photographs, video footage of you, your dependents, or other minors in your care who use our facilities, collected during your use of our facilities for publication and for use in advertising or promotional material. Such photographs or video footage may appear (whether on their own or in conjunction with other photographs, video footage and/or text graphics) on social media platforms such as Facebook; Instagram; Twitter; Youtube; and/or Snapchat. You hereby grant Team Yousfi the unfettered right to use all such photographs and/or video footage in such manner and hereby grant us permission to record, store, transmit, reproduce, replicate, modify, advertise and generally exploit all such photographs and video footage for our benefit and in such manner as we in our discretion deem appropriate. You consent to our use of all such footage in the manner described above and agree that the purpose for using such photos and/or video footage is for advertising, marketing and promotional purposes only and is not intended to insult, defame or slander any person. You acknowledge and agree that your consent and agreement to the above is given for yourself as well as on behalf any dependents or other minors in your care while using our facilities.  You also agree not to take photos for Commercial use without the consent of Team Yousfi.

25.    Staying up to Date with our Terms and Conditions
We may sometimes add to, change or remove our Terms and Conditions. The most up-to-date terms and conditions always apply. You can find the latest copy of the Membership Policy on our website.

26.    Governing Law and Jurisdiction
This agreement is governed by the laws of the United Arab Emirates, the Courts of which shall have exclusive jurisdiction
